Beth’s practice focuses on compliance with regulatory requirements, from the local to the federal level, and includes working with county agencies, regional water quality control boards, the State Water Resources Control Board, and the Environmental Protection Agency. She has provided clients with guidance in environmental compliance matters including investigation and remediation of contaminants, landlord-tenant issues, Proposition 65 requirements and environmental due diligence.
Past cases have involved representation of defendants in connection with loan agreements secured by contaminated property, and negotiation and preparation of indemnity and remediation agreements between private parties, and with public agencies such as the Department of Toxic Substances Control. Beth has helped clients resolve and settle notices of violation and administrative enforcement actions for alleged violations of waste discharge requirements, hazardous waste, and underground storage tank regulations.
She has advised clients regarding landlord-tenant issues such as asbestos, lead-based paint, vapor intrusion, radon and mold contamination (statutory notice requirements and abatement requirements, response to tenant concerns). She has also conducted environmental due diligence for project acquisitions and project financing and advised clients regarding the appropriate scope of environmental due diligence in real property acquisition transactions.
Her practice has included representation of clients in real estate disputes, general commercial litigation, and Proposition 65 lawsuits. Representative clients included large and small retailers, a real estate investment trust, and public agencies.
Prior to practicing law, Beth was a molecular and cellular biotechnology researcher at a large pharmaceutical company.
Beth is a member of the Executive Committee for the Environmental Section of the Alameda County Bar Association.
